If the doctor's office is not able to prove that the patients copay was in fact collected then the insurance company may demand a refund for any reimbursement paid. They could even cancel the contract with the doctor, preventing the doctor to provide services to other patients. It is also a felony in the USA to routinely waive copays, coinsurance, and deductibles for patients.
